TERMS AND CONDITIONS OF SALE
ESTHORA
PREAMBLE
These Terms and Conditions of Sale (hereinafter referred to as the “Terms and Conditions” or “T&Cs”) apply to any order placed by a natural person acting as a consumer within the meaning of French Consumer Law, on the website www.esthora.com (hereinafter the “Website”), with Aliénor Brizec, operating under the trade name ESTHORA.
Aliénor Brizec operates as a sole trader (micro-entrepreneur), with registered office at 200 rue de la Croix Nivert, 75015 Paris, France, registered with the Paris Trade and Companies Register (registration in progress). In accordance with the French VAT exemption scheme, no VAT number is applicable.

Any order placed on the Website implies full and unconditional acceptance of these Terms and Conditions by the Customer.
1 – DEFINITIONS
Customer: any natural person acting for non-professional purposes.
Order: purchase of one or more Products on the Website.
Products: pre-packaged 120 g chocolate bars sold on the Website.
Website: the website accessible at www.esthora.com.
Seller: Aliénor Brizec, operator of the ESTHORA Website.
2 – ACCEPTANCE AND ENFORCEABILITY
These Terms and Conditions are available at all times on the Website.
Before placing an Order, the Customer acknowledges having read and accepted these Terms and Conditions without reservation by ticking a mandatory acceptance checkbox prior to payment.
The applicable Terms and Conditions are those in force on the date of the Order.
3 – PRODUCTS
The Products offered for sale are pre-packaged food products (120 g chocolate bars).
The essential characteristics of the Products, including ingredients, allergens, weight and storage conditions, are detailed on each Product page.
Product photographs are provided for illustrative purposes only and are not contractually binding.
4 – AVAILABILITY
Products are offered subject to availability.
In the event that a Product becomes unavailable after an Order has been placed, the Customer will be informed by email and fully refunded.
5 – PRICES
Prices are displayed in euros, all taxes included (TTC). VAT is not applicable pursuant to article 293B of the French General Tax Code.
Delivery costs are not included in the Product price.
Delivery fees
- Mondial Relay delivery to a pick-up point: €4.10 (incl. tax)
- Free delivery for orders over €50 (incl. tax)
The Seller reserves the right to modify prices at any time. Prices applicable are those displayed at the time of the Order.
6 – ORDER AND PAYMENT
Payment is due in full at the time of placing the Order.
Accepted payment method:
- Credit/debit card via Stripe
An Order becomes final once payment has been confirmed.
7 – DELIVERY
7.1 Delivery areas
Delivery is available to the following countries:
- France
- Belgium
- Luxembourg
- Netherlands
- Spain
- Portugal
- Italy
7.2 Delivery terms
Orders are delivered exclusively to Mondial Relay pick-up points.
Delivery times are indicative only, depending on the carrier, and do not constitute a binding commitment.
The Seller cannot be held liable for delays attributable to the carrier.
8 – TRANSFER OF RISK
The risk of loss or damage to the Products is transferred to the Customer when the parcel is made available at the pick-up point.
9 – COMPLAINTS
Any complaint must be sent exclusively by email to contact@esthora.com within 48 hours of receipt of the Order.
Complaints relating to damaged Products must be accompanied by clear supporting photographs.
Failure to comply with these conditions will result in the complaint being rejected.
10 – NO RIGHT OF WITHDRAWAL
In accordance with article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to food products likely to deteriorate or expire rapidly.
No returns or refunds will be accepted once the Products have been delivered.
11 – CHOCOLATE, TEMPERATURE AND WEATHER CONDITIONS
The Customer is informed that chocolate is sensitive to heat.
The Seller shall not be held liable for:
- partial or total melting due to weather conditions,
- improper storage or handling after delivery.
The Customer is responsible for ensuring proper storage of the Products upon receipt.
12 – ALLERGENS
Information regarding allergens is provided on the Product pages.
The Customer is responsible for checking this information before placing an Order.
The Seller cannot be held liable for allergic reactions resulting from failure to consult this information.
13 – LIABILITY
The Seller’s liability is strictly limited to direct and foreseeable damages.
The Seller shall not be liable in cases of force majeure or where damage is attributable to the carrier or the Customer.
14 – PERSONAL DATA
Personal data collected is necessary for Order processing and customer relationship management.
The Customer has the right to access, rectify or delete their personal data by contacting contact@esthora.com.
A dedicated Privacy Policy will be made available on the Website.
15 – MEDIATION
In accordance with article L.612-1 of the French Consumer Code, the Customer may use a consumer mediation service free of charge.

16 – APPLICABLE LAW
These Terms and Conditions are governed by French law.
Any dispute shall fall under the jurisdiction of the competent French courts.
